Banking and financial disputes

We are conflict of interest free in acting against banks and our experience also includes disputes with other financial institutions and intra-financial market disputes. Our lawyers have particular experience in pursuing large and complex claims. We are known for the commercial approach we take to cases and for our careful analysis of the strengths and weaknesses of each side. Because of our strong reputation, over 50% of the group’s fee income comes from referrals from other law firms, accountants, financial advisors and expert witnesses.

Our clients include UK and offshore companies, financial institutions, hedge funds, finance industry professionals and high net worth investors. Industry sectors include property development and investment companies, hoteliers and care home owners. We have a niche area in advising clients in dispute with the Irish banks.

We are a leading law firm for the problems that have emerged with interest rate swaps; we have handled disputes involving more than 125 interest rate hedges of all kinds and complexities with a total notional value of some billions of pounds.

We work extensively with expert witnesses and have wide knowledge of sophisticated financial structures such as syndicated lending, structured finance, RMBS, CMBS, credit derivatives (CDOs, Credit Linked Notes) and benchmark manipulation (LIBOR, Forex, ISDAfix). Experts know that we possess the necessary technical knowledge to advise on cases involving complex derivatives and benchmark manipulation.

We also advise on the regulatory aspects that frequently arise in financial services disputes. The firm’s expertise also includes complex international trust arrangements involving trusts or assets held offshore.

We are members of the Alternative Investment Managers’ Association and the Loan Market Association and our access to each provides us with wide awareness of financial markets developments. The group has a heavy emphasis on developments in financial services law and regulation and has a programme of monthly know-how meetings with experts, counsel and other specialists. We are members of the professional panel of the All Party Parliamentary Group on Fair Business Banking -

We are internationally focused and have formed the Banking Litigation Network in response to the difficulty in many countries of finding law firms that are able and willing to handle complex claims against banks.

We have extensive connections with third party litigation funders and also with insurers (ATE insurers) to provide our clients with cover against having to pay an opponent’s litigation costs.

We are ranked in the two leading legal directories (Legal 500 and Chambers & Partners).

Stephen Rosen who heads the group is a member of the Financial Services Lawyers Association and a member of the Fraud Advisory Panel.
